Collecting Personal Information
MBB will be fair and open about the way we collect information about you and what we intend to do with the information. We collect and hold information reasonable necessary for or directly related to one or more of our functions or activities. The types of personal information we collect includes but is not limited to your name, gender, occupation and employment details, contact details, address details, registration and drivers licence details, credit card and bank account details, other financial information, current and past vehicle information and details, cookies and website tracking, location through anti-theft vehicle tracking technology, voice and image, educational qualifications and resume and personal interests.
MBB collects most personal information directly from you, for example when you provide information through enquiry or purchase, service, parts or when you request we assist in the facilitation of finance or insurance. We also gather information from third party roadside assistance service providers, via our website or social media, from a competition or promotion we run (either directly or through our marketing agents), from publicly available sources, third party service providers, from government bodies, enforcements and regulatory authorities, and when you apply to work with us or through a recruitment / employment agency.
If we receive information about you from a third party, wherever practical we will make sure they undertake to comply with the Privacy Act.
The vehicles sold by MBB may have a number of sophisticated computer systems that monitor and control several aspects of the vehicle’s performance. Many vehicles in the Mercedes-Benz range use on-board vehicle computers to monitor and store driver information. Some information may be stored during regular operations to facilitate repair of detected malfunctions; other information is stored only in certain collision events by computer systems, such as those commonly called Event Data Recorders (EDR). The information from EDR’s, if available, is used to improve customer and driver safety, better understand what happens to vehicles in the event of a collision and shall be provided to the police on request.
How We Use Personal Information
MBB only collects, holds and handles information about you that is necessary for us to perform the services you request from us, that is otherwise reasonably necessary for our business activities or to comply with our legal, regulatory, industry or workplace requirements.
We may use personal information we collect about you for a number of purposes including but not limited to:
• Any purpose you have consent to;
• To facilitate the delivery of goods and services which you have enquired about or have purchased from us;
• To tell you about other products and services that may be of interest to you;
• To learn more about your level of satisfaction, your expectations of us and how we can meet them;
• To ensure that any warranty claim has been properly administered;
• Marketing, event and promotional activities;
• To consider you for an employment position within MBB for which you have applied;
• To acquire goods and services from you or from your employer;
• To ensure that you are contacted as soon as possible in the event of a safety-related product recall;
• Fulfilling and processing orders and administering accounts;
• For other purposes to which you have consented; and
• As required or permitted by relevant laws and regulations.
Generally, we may use your personal information for the purposes for which we collected it and for related purposes which would be reasonably expected by you.
If you do not provide your personal information, MBB is less able to perform the above functions.
Disclosure
We collect information personal information to provide you with the best possible products and services offered through our dealership and create a more personalised experience for you. Other purposes include but not limited to:
• Those that have consented we disclose personal information to;
• Mercedes-Benz Australia/Pacific Pty Ltd;
• Our authorised dealer network;
• Contracted service providers;
• Related and other Daimler Group companies; and
• As required by an enforcement authority, regulator, law, court or tribunal.
MBB may need to disclose personal information outside of the jurisdiction from which it was collected. When we disclose your information overseas, MBB is generally required to take reasonable measures to ensure that your information is held, managed and accessed in accordance with the standards that apply in Australia. We will not sell, rent or trade your information to/with any other organisation.
Consent
We may require your consent to use and/or disclose your personal information if we need to use your information for a purpose that is not related to the purpose for which it was collected. If you do not consent to MBB collecting, using and/or disclosing your personal information, this may affect our ability to deliver and improve our products and services to you.
Marketing and Privacy
MBB sends marketing material to its customers and other people who have provided MBB with personal information from time to time about products and services offered by MBB. We only send out marketing material to you if you have ‘opted in’ on our privacy form. The marketing material may be in the way of mail, email, phone or SMS, depending on what you have opted into.
If you do not wish to further receive marketing material from MBB, its businesses or its affiliates, please complete the ‘opt out’ provision on the marketing information form provided by emailing admin@mbballarat.com.au. MBB will note your request and respect your wish not to receive any marketing materials. If you choose not to receive any marketing materials from MBB, you may miss out on special products, event invitations and service offerings and opportunities.
Protecting Personal Information
MBB will keep your personal information secure by taking reasonable steps to protect it from misuse, loss and unauthorised access, modification and disclosure. MBB stores personal information in hard copy and electronic achieve systems for a period MBB considers reasonable depending on the primary purpose for which that information was collected. Only properly authorised people who have a need to access personal information to perform their job will be able to see or use that information.
MBB will take reasonable steps to keep any personal information we hold about you secure. However, except to the extent liability cannot be excluded due to the operation of statute, we exclude all liability (including negligence) for the consequences of any unauthorised access to, disclosure of misuse of or loss or corruption of your personal information. Please notify us immediately if you become aware of any breach of security.
Access to information we hold about you
At any time you can request access to information we hold about you. We aim to respond to your request within 30 days. We may charge a reasonable fee for information requests. If an exception in the Privacy Act applies to your access request, we will work with you and attempt to provide you with access in a way to meet both our needs.
We will strive to ensure that information about you is accurate when we collect or use it. If you details change, it’s your responsibility to update the relevant details with us.
Complaints and Enquiries
If you are not happy with the way we have handled your personal information or believe that we have breached the Privacy Act or APPs then please contact us and we will try our best to resolve the matter with you. For security reasons, we request that complaints, requests for access to or correction of personal information or any enquiries or questions concerning privacy matters be put in writing and either emailed or posted to;

We may also require documentary proof of your identity depending on your request.
MBB will provide acknowledgement of your complaint within 7 days of receipt. We will then investigate and advise you of the steps we have taken to resolve your complaint within 30 days of the receipt of your complaint.
